Pre-Foreclosures?
What is a Pre-Foreclosure?
ans. A Pre-Foreclosure is Real-Estate (Real-Property) that is pending sell due to non-payment or delinquent mortgage-note payments. Specifically, it is the time period that begins when a borrower or an owners' loan payments becomes delinquent and the lender files a legal notice to Foreclose on the Property-up until the actual Sale date. During this "grace period" these Properties pending sale (but not actually sold-to-date) are considered Pre-Foreclosures. If the property is not sold at the Public Sale or Auction, usually conducted at a County Courthouse, the property is turn-over to the Bank or Lender, thus becoming a Bank or Lender REO-Real Estate Owned or Foreclosed Property. Who Puts together "Newsletters and Websites" that Publicize or Advertise Pre-Foreclosures?
ans. First, let's make a clear distinction: Pre-Foreclosures -vs- Foreclosures. While Preforeclosures are in the Foreclosure process, (sometimes referred to as Foreclosures), properties have not actually been "Foreclosed", or have not been turned-over to the Bank or Lender as an REO or Foreclosed Property. While in this stage, properties are technically considered to be "Pre-Foreclosures". A Pre-Foreclosure is a property that is in the Foreclosure Stage that is pending Foreclosure - a/the legal process that is initiated, due to unpaid or delinquent payments, by a Private Bank, Private Lender, or a Commericial Bank or Lender.
Based on information gathered, Newsletters and Websites, are created by individuals or companies that have the resources to consolidate this information or data, for the general public, in a reader-friendly format, or to share information, with the general public, on locating what is considered by some to be difficult to find data. To quote a very popular Pre-Foreclosure Instructor: "A number of Individuals who do like to research Foreclosures are commercial-former Newsletter Producers, because it is electronically faster and cheaper, who have moved to putting them on their website".
Are Pre-Foreclosures part of the legal process?
ans. According to the following "quote": "All foreclosures are part of the legal records". "All Public Records or most property records are available whenever a Lender files a Foreclosure Notice that goes into the Clerks' Office; the clerk records it and then that becomes a part of the Public Records that is available to anybody."
''You can research property, prices, or a lien against a particular property". "More and More Assesors or Property Tax Assessor Offices, Clerk Record Offices and All of those folks that keep those Public Records are making this data available on the Internet" - thus giving public notice that the property has a legal claim against it. Keep in mind, that this does not mean that the county of record (where the property is located) will utilize the Internet exclusively. In other words, most may find that the Internet is another alternative to post such notices.
Do Pre-Foreclosures have Delinquent Taxes?
ans. Usually, if a Home-Owner is late on his/her (their) payment or mortgage, it is likely that the property taxes are also delinquent. It is always a great idea to contact the Tax Office in your county to inquire about the status of the Property-Taxes for Pre-Foreclosures.
How Do I Determine the Home Value of Pre-Foreclosures?
ans. Suggested Tips for Determining Pre-Foreclosed Properties Home Values:
- Contact a Licensed Appraiser
- Visit Your Local Tax Assessors Office
- Visit the Countys' Tax Records Office
- Ask the Current Owner for Last Appraised Home Value

Where Can I Locate Pre-Foreclosure Listings?
ans. As a general rule, most Pre Foreclosure information is "Public Information". Locating the proper office or contact; however, can be (often times) very challenging and time-consuming. To start, check with the County Clerks' Office in your area; the Tax Assessors' Office, or the Tax Commissioners' Office, etc. for the name of the the particular "LEGAL ORGAN" (Newspaper) and the "DATES" for which Pre-Foreclosures (NOD, LIS, etc.) are advertised. A limited number of Pre-Foreclosure Listings MAY also be accessed through our website-portal (via- hyperlinks).
